Early Access Program Terms

These Early Access Program Terms supplement the sketcHVAC General Terms and Conditions. By applying for, accessing, or using sketcHVAC under the Early Access program, the User accepts these specific terms in addition to the General Terms and Conditions applicable to the App.

In the event of any conflict between these Early Access Program Terms and the General Terms and Conditions, these specific terms shall prevail only with respect to the access, use, and limitations specific to the Early Access program.

1. Nature of the Early Access Program

The purpose of the Early Access program is to allow selected professional users to evaluate sketcHVAC before its full commercial release.

Access is granted exclusively for testing, technical evaluation, functional validation, and the collection of feedback from qualified users.

The Early Access program does not constitute a final commercial subscription, a sale of a permanent license, or any guarantee of future availability of the service.

2. Limited and Discretionary Access

Acceptance into the Early Access program is subject to review and approval by the sketcHVAC provider.

The provider may accept, reject, limit, suspend, or cancel any Early Access request or access at its sole discretion, especially in cases of misuse, excessive use, security risks, breach of these terms, or lack of suitability for the professional profile intended for the App.

Early Access is personal, temporary, limited, and non-transferable.

3. Testing Credits

Early Access users may receive a limited number of testing credits to evaluate the main features of the App.

These credits are provided exclusively for evaluation purposes and do not constitute a commercial subscription, monetary balance, acquired right, refund, compensation, or means of payment.

The provider may define, modify, increase, reduce, or cancel the testing credits assigned depending on the scope of the evaluation, technical availability, usage behavior, or the needs of the program.

Testing credits may be subject to usage limits, expiration, functional restrictions, or additional conditions communicated by the provider.

4. Features Under Development

The User acknowledges that sketcHVAC is in Early Access and that certain features, calculations, reports, integrations, automations, interfaces, workflows, commercial plans, or prices may be incomplete, subject to change, fail, be removed, or not be permanently available.

The provider does not guarantee that the features available during Early Access will remain unchanged in the final commercial version.

5. Mandatory Professional Review

All results, calculations, reports, tables, charts, estimates, documents, or any other outputs generated during the Early Access program must be independently reviewed, verified, and validated by a qualified professional before being used for any real-world purpose.

The User acknowledges that outputs generated during Early Access are preliminary, informational, and provided for support purposes only, and do not replace professional judgment, detailed engineering, independent verification, or compliance with applicable regulations.

This condition applies without prejudice to the provisions set out in the sketcHVAC General Terms and Conditions.

6. Permitted Use

The User agrees to use Early Access only for professional, technical, and evaluation purposes related to the intended scope of sketcHVAC.

The User is prohibited from using the Early Access program to:

provide commercial services to third parties without express authorization;
resell, transfer, or share access;
make abusive, automated, or disproportionate use of the platform;
attempt to bypass credit, usage, or security limits;
upload illegal or unauthorized information, or information for which the User does not have usage rights;
use the App in any way contrary to the General Terms and Conditions.

7. Confidential Information and Project Data

The User must refrain from entering confidential, sensitive, regulated, or contractually restricted information into the App unless they have the necessary authorization to do so.

The User is responsible for anonymizing, limiting, or removing any client, project, facility, location, or process information that should not be shared or processed through the App.

The provider may use aggregated, anonymized, or non-identifiable information derived from the use of the Early Access program to improve the App, analyze its performance, and prioritize future developments.

8. User Feedback

The User may provide comments, suggestions, technical observations, bug reports, improvement requests, or other feedback related to sketcHVAC.

The User authorizes the provider to use such feedback freely, free of charge, indefinitely, and without any obligation of compensation, for the purpose of improving, modifying, developing, documenting, commercializing, or adapting the App.

Submitting feedback does not grant the User any intellectual property rights over sketcHVAC, its features, future developments, or implemented improvements.

9. Prices and Commercial Plans

The prices, plans, credits, features, and commercial conditions displayed on the website during the Early Access period are provided for informational purposes and may be modified before the final commercial release.

Participation in the Early Access program does not guarantee future free access, price retention, availability of a specific plan, or automatic preferential commercial conditions, unless expressly communicated in writing by the provider.

10. End of Early Access

The provider may terminate the Early Access program at any time, in whole or in part, with or without prior notice.

Once the Early Access period has ended, access to sketcHVAC may be suspended, limited, or made subject to the purchase of a commercial plan.

The provider shall not be liable for loss of access, expiration of testing credits, functional changes, or unavailability of the service after the end of the Early Access program.

11. Application of the General Terms and Conditions

Unless expressly stated otherwise in these Early Access Program Terms, the use of sketcHVAC during Early Access shall be governed by the App’s General Terms and Conditions.

In particular, the provisions relating to professional use, informational nature of outputs, independent professional review, disclaimer of warranties, limitation of liability, assumption of risk, indemnification, governing law, and jurisdiction shall fully apply.

12. Acceptance

By applying for, accessing, or using sketcHVAC under the Early Access program, the User declares that they have read, understood, and accepted these Early Access Program Terms, as well as the sketcHVAC General Terms and Conditions.

If the User does not accept these terms, they must refrain from applying for or using Early Access.
