Terms and Conditions

1. Scope and Purpose

This application (the "App") is provided exclusively as a professional tool for supporting and assisting with engineering calculations, simulations, estimations, documentation, and data visualization related to engineering projects, including, but not limited to, HVAC systems, cleanrooms, GMP facilities, laboratories, hospitals, data centers, and other technically complex or regulated environments.

The App does not replace professional engineering judgment, engineering services performed by licensed professionals, regulatory approvals, or independent technical verification.

2. Professional Use Only

The App is intended solely for use by qualified professionals, including licensed engineers, engineering consultants, designers, and other individuals with appropriate technical education, training, and experience.

By accessing or using the App, the User represents and warrants that they:

  • are a competent professional in the relevant technical field;

  • understand the limitations of automated calculations, assumptions, and engineering models; and

  • accept full professional responsibility for all decisions, designs, and actions based on the results generated by the App.

3. Informational Nature of the Results

All calculations, simulations, reports, estimates, charts, tables, and any other outputs generated by the App:

  • are based solely on the information provided by the User;

  • rely on engineering assumptions, simplifications, approximations, and generalized models; and

  • are provided exclusively for informational and decision-support purposes.

The results do not constitute, and shall not be interpreted as:

  • professional engineering advice;

  • signed, sealed, certified, or otherwise officially approved engineering documents;

  • final construction documents, construction-ready designs, or as-built documentation;

  • regulatory approvals, certifications, or validations; or

  • legally binding or contractual documents.

4. Mandatory Independent Professional Review

All outputs generated by the App must be independently reviewed, verified, and validated by a licensed professional engineer or other legally authorized specialist, in accordance with all applicable laws, regulations, codes, and professional standards, before being used for any real-world purpose, including but not limited to:

  • engineering design or detailed engineering;

  • permit applications or submissions to regulatory authorities;

  • construction or installation;

  • commissioning, qualification, or validation;

  • audits, inspections, or compliance activities; or

  • operational or investment decisions.

Any use of the App's outputs without such independent professional review shall be entirely at the User's own risk.

5. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APP PROVIDER EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING, WITHOUT LIMITATION:

  • implied warranties of merchantability;

  • fitness for a particular purpose;

  • accuracy, completeness, or reliability of any results;

  • non-infringement; and

  • uninterrupted, error-free, or secure operation of the App.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, UNDER NO CIRCUMSTANCES SHALL THE APP PROVIDER, ITS OWNERS, DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS, OR AFFILIATES BE LIABLE FOR:

  • direct, indirect, incidental, special, consequential, or exemplary damages;

  • loss of profits, revenue, business, data, or use;

  • project delays, cost overruns, or rework;

  • regulatory fines, penalties, or sanctions;

  • design, construction, commissioning, or operational failures; or

  • any damages arising out of or relating to the use, misuse, or inability to use the App or any of its outputs, even if advised of the possibility of such damages.

7. Assumption of Risk

The User expressly acknowledges and agrees that:

  • the use of the App involves inherent engineering, technical, and professional risks;

  • any reliance placed on the App's outputs is entirely voluntary; and

  • the User assumes full responsibility for all risks and liabilities arising from such use.

8. Indemnification

The User agrees to defend, indemnify, and hold harmless the App Provider from and against any claims, demands, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising out of or relating to:

  • the User's use or misuse of the App;

  • reliance upon or application of any outputs generated by the App;

  • violations of applicable laws, regulations, or professional standards; or

  • claims brought by clients, contractors, regulatory authorities, or other third parties in connection with the User's professional work.

9. No Exclusive Reliance

The User expressly acknowledges that they have not relied upon the App or any of its outputs as the sole or primary basis for any professional, technical, financial, regulatory, or business decision.

10. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of Chile, without regard to its conflict of laws principles.

Any legal action, claim, or proceeding arising out of or relating to these Terms, the App, or its use shall be submitted exclusively to the competent ordinary courts of the city of Santiago, Republic of Chile.

The User irrevocably accepts such jurisdiction and venue and waives any objection based on lack of personal jurisdiction, forum non conveniens, or any similar doctrine.

11. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, such provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall remain in full force and effect.

12. Acceptance of the Terms

By accessing or using the App, the User acknowledges that they have read, understood, and agree to be legally bound by these Terms and Conditions.

If the User does not agree with these Terms, they must immediately discontinue use of the App.
